Terms & Conditions

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You may delete your account at any time through the Data Privacy page in RQST Backstage (sign-in required). Account deletion immediately cancels any active subscription and anonymizes your account information. Your data will be permanently deleted after a 90-day retention period for legal compliance purposes. Deletion is irreversible after the retention period.

• Free Accounts: Limited to profile creation. Free accounts do not include a Backstage trial.
• Paid Accounts: Include full Backstage access, such as tips, requests, live setlists, gig promotion, booking tools, and vanity URLs.
• Downgrades: Downgrading removes access to Backstage features and forfeits your vanity URL.

• Artists retain full discretion over what they perform. Requests are not guaranteed.
• Tips and requests are always non-refundable.
• Payments are processed by third-party providers; RQST is not liable for errors or issues.

• Subscriptions auto-renew until canceled.
• You may cancel at any time, but charges already incurred are non-refundable.
• Downgrading removes access to paid features immediately.
• Account deletion automatically cancels your subscription. Your subscription remains active until the end of the current billing period, but no refunds will be issued for the remaining period after deletion.
• Free Basic accounts do not include a Backstage trial.
• New Backstage subscribers may receive a one-time 14-day free trial through Polar.sh at checkout; a payment method is required.
• Trial access includes the Backstage features of the selected plan, including vanity URLs where applicable.
• Cancel before the trial ends to avoid being charged; otherwise the subscription auto-renews at the plan rate.
• Trial eligibility, duration, and billing are subject to the billing provider’s terms.

• Subscription fees are non-refundable.
• Tips and requests are final.
• No refunds are issued if your account is terminated due to violations of these Terms.

• All chargebacks and disputes are handled through Polar.sh, Venmo, or Stripe.
• RQST is not responsible for mediating such disputes.
• Accounts with excessive chargebacks may be suspended or terminated.

RQST does not guarantee that any request will be fulfilled. Artists retain discretion in choosing what to perform.

Artists retain ownership of their content but grant RQST the right to display it within the Platform. Artists are solely responsible for ensuring content legality.

Artists are solely responsible for copyright compliance. RQST is not liable for copyright claims related to artist content.

You may not engage in harassment, spam, fraud, or any misuse of the Platform. Prohibited activities include, but are not limited to:

• Harassment, bullying, or threatening behavior toward other users
• Spam, unsolicited messages, or automated bulk communications
• Fraudulent transactions, chargebacks, or payment disputes made in bad faith
• Impersonation of other users, artists, or entities
• Uploading malicious code, viruses, or harmful content
• Attempting to gain unauthorized access to accounts or systems
• Violating any applicable laws or regulations

Violations of these prohibitions may result in immediate account suspension or termination, forfeiture of any fees paid, and potential legal action.

The RQST name, logo, and Platform design are the property of RQST. Unauthorized use is prohibited.

Certain decorative visual assets used on the public RQST website are licensed from third parties. Attribution for those assets is maintained in these Terms and is not displayed in the public marketing interface.

The Platform is provided “as is” without warranties of any kind.

RQST is not liable for indirect, incidental, or consequential damages.

We may suspend or terminate accounts for violations of these Terms. This is distinct from user-initiated account deletion.

User-Initiated Deletion: You may delete your account at any time through the Data Privacy page in RQST Backstage. This results in immediate soft delete (anonymization), a 90-day retention period, and then permanent deletion. User-initiated deletion is self-service and cannot be undone after the retention period.

RQST-Initiated Termination: We may terminate accounts immediately for violations of these Terms. Such terminations are typically immediate and may result in forfeiture of fees paid.

Automatic Removal for Incomplete Basic Accounts: Separate from violation-based termination, we may deactivate incomplete free Basic accounts under Section 17. That process uses reminder emails, a short notice period after the final reminder, then the same anonymization and retention approach as user-initiated deletion in Section 2.

These Terms are governed by the laws of the State of Ohio, United States.

RQST Basic accounts are intended for artists who are actively creating a public Spotlight page. If a free Basic account remains incomplete, RQST may deactivate it and any unpublished profile data associated with it after following the notice process below.

Who is affected: This policy applies to free Basic accounts that have not completed the required artist profile fields and published a Spotlight page. It does not apply to paid Backstage accounts, accounts with an active paid subscription, admin accounts, or profiles that are complete and published.

Reminder emails: We send service (transactional) reminder emails to the address on your account:

• First reminder: approximately 90 days after account creation (for accounts still in the 90–109 day range).
• Final reminder: approximately 110 days after account creation, or—for older accounts that pre-date this policy—the final reminder only, without the first reminder.

Removal timing: If your profile is still incomplete after the final reminder, we may deactivate your account at least 10 days after that email is sent, once your account has reached approximately 120 days of age. Completing the required profile fields and publishing your Spotlight page before deactivation prevents removal under this policy.

What deactivation means: Deactivation disables sign-in and unpublishes your Spotlight page. We promptly anonymize personal identifiers (such as your email, display name, and profile content) in line with Section 2. Non-identifying account metadata may be retained for up to 90 days, then permanently deleted, except where minimal records are required by law.

If you believe your account was deactivated in error or you need access restored, contact hello@rqst.live before the retention period ends. We may, at our discretion, reinstate an account and allow additional time to complete your profile.

We may issue promotional codes. These are non-transferable, may not be resold, and may be revoked if misused.

• Affiliates earn $20 per new paid account referred (monthly or annual subscriptions).
• Referrals qualify only after the referred account completes the required payments (two successful monthly payments or one successful annual payment).
• Commissions are subject to a cooldown after qualification before becoming payable (7 days for monthly, 30 days for annual).
• Payouts are released once the affiliate balance reaches $40 or more.
• Fraudulent or spammy activity voids commissions.

We may update these Terms periodically. Continued use constitutes acceptance.

The Platform uses real-time communication services to provide live status updates, requests, and setlists. Connection status and real-time functionality are dependent on third-party services and network conditions. RQST does not guarantee uninterrupted real-time service availability, and connection issues may occur. You acknowledge that real-time features may experience delays, interruptions, or failures beyond our control.

Email verification is required to create and maintain an account on the Platform. Unverified accounts may have restricted access to certain features. You are responsible for maintaining a valid, accessible email address associated with your account. If you are unable to verify your email or access your account email, your account may be suspended or terminated.

QR codes generated through the Platform are intended for legitimate use by artists to direct fans to their profiles. Misuse of QR codes, including but not limited to unauthorized modification, distribution for fraudulent purposes, or use in violation of these Terms, may result in immediate account termination. Artists are responsible for the appropriate use and distribution of their QR codes.

The Platform is available globally, subject to local laws and regulations. We reserve the right to restrict access to the Platform in certain jurisdictions where prohibited by law. By using the Platform, you represent that you are not located in a jurisdiction where use of the Platform would be illegal or prohibited.

The Platform is provided “as available” and “as is.” We do not guarantee that the Platform will be available at all times or that it will be free from errors, interruptions, or downtime. We may perform maintenance, updates, or modifications that temporarily affect Platform availability. RQST is not liable for any losses or damages resulting from Platform unavailability or interruptions.

RQST reserves the right to review, moderate, and remove any content that violates these Terms or is otherwise objectionable. We may take action including content removal, account warnings, temporary suspension, or permanent termination. Our content moderation decisions are final. Examples of content that may be removed include, but are not limited to, content that is illegal, harmful, threatening, abusive, defamatory, or infringes on intellectual property rights.

Artists are solely responsible for all content they submit, upload, link, embed, or display through RQST, including Electronic Press Kit (EPK) photos, music links, video links, press quotes, and related promotional materials. By adding media to an EPK or other public-facing RQST profile, you represent that you own or have obtained all necessary rights, licenses, and permissions to share that content.

RQST does not host artist music or video files directly in EPKs for general distribution. Where supported, EPKs display third-party embeds or external links to services such as Spotify, SoundCloud, Bandcamp, Apple Music, YouTube, and Vimeo. You are responsible for ensuring linked and embedded content complies with the terms, policies, and copyright rules of those platforms.

RQST may remove links, assets, or EPK content that appears to infringe intellectual property rights, violate these Terms, or create legal or platform risk, without prior notice. RQST is not responsible for disputes arising from artist-submitted content, including claims of unauthorized use, misrepresentation, or copyright infringement.

If you are located in the European Economic Area (EEA), United Kingdom, or California, you have certain rights regarding your personal data:

• Right to Access: You may request a copy of the personal data we hold about you.
• Right to Rectification: You may request correction of inaccurate or incomplete data.
• Right to Erasure: You may request deletion of your personal data, subject to legal obligations.
• Right to Data Portability: You may request transfer of your data to another service provider.
• Right to Object: You may object to processing of your personal data for certain purposes.
• Right to Restrict Processing: You may request limitation of how we process your data.

You can exercise many of these rights through self-service features:

• Account Deletion: Delete your account through the Data Privacy page in RQST Backstage
• Cookie Preferences: Manage your cookie preferences at /privacy/cookies

For other requests or to exercise additional rights, contact us at hello@rqst.live. We process your data based on contractual necessity, legitimate interests, and consent where applicable. We will respond to your requests within 30 days, or as required by applicable law.

Automated cleanup of long-inactive incomplete Basic accounts (Section 17) is based on our legitimate interest in maintaining an accurate, active platform and on performance of our agreement with you to provide the service. You may object to that processing or request erasure at any time by completing your profile, using self-service deletion in Backstage, or contacting hello@rqst.live.

The Platform is operated from the United States. If you access the Platform from outside the United States, you acknowledge that your data may be transferred to, stored, and processed in the United States. By using the Platform, you consent to such transfer and processing. These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved in the courts of Ohio, United States, unless otherwise required by applicable law in your jurisdiction.

Artists may opt in to receive occasional marketing communications from RQST, including product updates, onboarding resources, and feature tips. Opting in is voluntary and does not affect access to the Platform. We only send marketing messages when you explicitly grant consent through in-product forms such as checkout or feedback submissions.

Marketing emails are delivered through our processor Brevo (formerly Sendinblue). When you opt in, we share your email address and optional name information with Brevo solely to deliver those communications. We do not sell, rent, or otherwise broker your mailing list data.

You can unsubscribe at any time using the links in each email or by contacting hello@rqst.live. Opting out of marketing emails does not affect transactional or account-related communications that are required to provide the service, including incomplete-account reminder emails described in Section 17.
